An FIR was filed April 2013 by the brother-in-law of the 11 year old victim that she was missing for the last 2 days. Based on this, a search was organised by the general public and the police to find the victim and she was found dead in a nala the next day. Investigations found that she was raped and murdered.

Further investigations and actions taken on the case raised grave concerns as to whether the victim and her family would receive justice. Since many discrepancies were found in statements made by all the parties concerned, it was decided that a fact-finding team comprising of concerned citizens from different NGOs working towards the protection of civil rights and justice for the oppressed would visit Nalgonda and meet the victim’s family and the police. The aim of this mission was to be objective in arriving at the truth. Sankalp was a part of the team that visited Nalgonda and talked to various police officials, the relatives and neighbours of the victim. A report based on narratives of the victim’s kith and kin and the police details was prepared by Sankalp and submitted to the AP State Minorities Commission in June 2013 for further action. Investigations in the case reveals amounts paid as compensation from individuals and government agencies to the family.

A 13 year old was allegedly gangraped by 3 men in May 2013. The survivor never told anyone about the rape as she was too scared. The crime came to light when her stomach started showing and her grandmother questioned her after which the FIR was filed on August 2013 The accused and two of his friends all around 20 years of age were subsequently arrested and criminal cases have been booked under Section 376 (g) IPC r/w 376 (2) (n) IPC & 376 D Criminal Law (Amendment) Act -2013 and Section 6 of the Protection of Children from Sexual offence Act 2012.

Sankalp has supported the survivor in dealing with the government agencies such as Police, Government Hospitals, Collectorate, District Child Protection Unit, Child Welfare Committee etc. Sankalp on various occasions has taken the survivor to the hospital for check-ups, blood transfusion and final delivery. Follow-up with the Police for medical reports which were needed for the compensation has also been done almost on a daily basis. Sankalp has also repeatedly followed up with the Collectorate and Women & Child Development Agency and is instrumental in getting the amount of Rs. 25,000 due to the survivor. A petition was filed with the Child Welfare Committee and the District Child Protection Unit to ensure that the necessary care & rehabilitation be given to the survivor.

A report has been submitted to the Police, Collectorate, Women & Child Welfare Department, Child Welfare Committee, Women & Child Development Agency and District Child Protection Unit.

A student of a local polytechnic college was allegedly abducted in April 2012 and raped by the college canteen owner. The next day, her family received a call from her stating that she was going to Bangalore and not to search for her. She hung up before they could ask anything further. Her uncle filed an FIR at the local police station stating that she was missing.

After 17 months, the survivor escaped from the accused clutches and reached her house in September 2013. A complaint was filed at the Police station on the day after she came back. Cases under IPC Section 366 (kidnap, abduction or inducing to compel for marriage), 376 (rape), 323, 342 (wrongful confinement) and 506 (criminal intimidation) were filed against the accused. He was arrested immediately.

With the aim of supporting the survivor, the Sankalp team conducted a fact finding mission and first met the Inspector of the Police Station a week later and after 2 days met the survivor, her mother and other relatives to find out the facts. The following facts were found out –  the survivor was kept in three different houses and alleges that she had become pregnant as a result of being raped and was forced to undergo an abortion at a local hospital.. The accused is a married man and his family comprising of his wife, brother and father were party to the crime as they knew what was happening and even came to the second location of the survivor’s confinement a number of times and abused her verbally and physically. There is a communal angle to the story as the survivor claims that the accused and his family told her that she deserved such treatment because she was a Muslim.

Sankalp apprised the then DCP of the area of the circumstances and action was immediately taken by the police to diffuse the situation as this was during the period of the Ganesh immersion.

A report has been submitted to the AP State Minorities Commission with all details of the case and the facts found.

An FIR was filed on December 2013 by a daily wages labourer, a resident of the Old City, Hyderabad. She was recruited by the accused to do some masonry work at his house at 9 am on that day. After working till 2.30 pm, she asked if she could go for lunch and the accused asked her to go to the 2^nd floor and clean the area before going. He then followed her and allegedly raped her.

In January 2014, the ACP of the Division informed Sankalp about the case and asked us to support the survivor. Sankalp has supported her in dealing with the government agencies such as Police, Government Hospitals and lawyers to pursue the case. Sankalp on various occasions has taken the survivor to diagnostics centres & hospitals for tests/check-ups as she was complaining of severe stomach pain. As the survivor has also received calls asking for withdrawal of the case and was warned that she would not get work at the labour adda, the team met with labour union leaders to ensure that she would get work. Sankalp has also continuously followed up with the police for the forensic lab report and filing of the chargesheet. 

The mother of the 7 year old girl filed an FIR on June 2014 stating that while she and her husband were away at work, her daughter was playing outside in the lane near their house at 6 pm on the previous day when she was enticed by the accused with a chocolate and taken to his house where she was allegedly raped by him. The nest day, the mother went to the local police station and lodged the FIR and criminal cases have been booked under Section 376 (2) IPC, Section 5 (m) r/w 6 of the Protection of Children from Sexual offence Act 2012 and Section 3 (2)(v) of SC/ST (Prevention of Atrocities) Act 1989.

Sankalp Women’s Support Alliance was asked to take up case by a well-wisher of the family. The team went to the Police Station a week later and met the ACP & Station Writer to find out further details on the case.  Initially, the Sankalp team met with the survivor and her father and aunt. Her mother was away at work. The survivor was traumatised and could not talk and her aunt related the incident in her words. Her father seemed to be reluctant to take up the case due to the social stigma.

The mother of the girl contacted Sankalp a few months later as she wanted to take pursue the case. The father had abandoned the family and she was unaware of the help that Sankalp could provide until another NGO – Kriti had given her Sankalp’s details. The mother’s aim is to ensure that the accused is convicted so that she and her daughter not only get justice but he does not harm another girl or woman again.

With the help of Sankalp, the survivor has received counselling to overcome the trauma and is now attending school. The process of receiving the requisite compensation due from the various Government agencies is also being facilitated by Sankalp. The chargesheet has been filed and Sankalp and the legal team are pursuing it on behalf of the survivor and her mother.

It has been alleged that on August 2014, a 17 year old maid servant who worked at a gated community in the city was gangraped and while bleeding profusely, she was taken to a hospital where she subsequently died.

Sankalp Women’s Support Alliance was contacted by a resident of the gated community 10 days later and apprised of the incidents that allegedly occurred. On the same day, the team also visited the location and the adjoining basti and made some enquiries. Detailed fact finding was done on the subsequent days and many discrepancies were found in statements made by the parties concerned and residents and workers of the gated community.  A girl was also produced by the alleged accused party stating that she was the maid servant. It was also found that an attempt to file an FIR was made by the State Domestic Workers Union and the National Domestic Workers Movement but could not be done as the one of the alleged accused was a high profile individual.

With the aim of finding out the truth, the Sankalp team approached the police and on the behest of the DCP, a meeting with the ACP of the Division was organised in September 2014. The meeting was attended by the Sankalp team, along with State Domestic Workers Union, the National Domestic Workers Movement and other groups with the aim of filing an FIR so that further investigation can be done. The team was with the ACP for over 3 hours petitioning for an FIR to be filed but it was refused. The team then made a written petition for the FIR to be filed which was accepted by the ACP. The case is underway and the team is awaiting to meet senior officials. The team also visited the hospital where she was admitted after being gangraped and spoke with the Director who was very evasive about the facts.

The case could not be taken further as it was heavily politicised.
